You need to be present in US at time of applying for the extension and when its approved. Said that in your case I think it would be fine to start H1B extension process after you are back. May be to be safe you can try doing it premium(if company is ready to spend extra money) as it gets done usually in less than a month.

I am in the middle of H1-B transfer from Comp A to Comp B.. I have an urgent question,
Company A didn't run my payroll from 11/26/07-4/11/08 because i was out of the project,since then i have had a consistent payroll no gaps, my question is
1.will that affect my H1-b transfer?
I dont think it will affect as per my knowledge, in verst case, they might ask for your 2008 W2 from the old company and I assume that you had on payroll from May to year end, so you can show that if they ask
2.will USCIS go back that far to verify my paystubs?, and
Normall they will go back to 6 months max, but be prepare to submit the Client letter to prove that you have project for next couple of years, keep in mind that if you show client letter for only few months, USCIS is will issue only for that period, it happened for couple of guys....these days proof of project is a key for transfers...good luck....

WASHINGTON � U.S. Citizenship and Immigrations Services (USCIS) published a Federal Register notice on April 28, 2009 that changed the filing location and filing instructions for the Application to Replace Permanent Resident Card (Form I-90). The revised filing instructions require applicants to submit supporting documentation with their applications. You would need to take an updated affidavit of support and you latest tax returns if you have filed for any dependents and they have been called for the interview also. Would be useful for you to take the I-140 approval with you. All your original certificates, including birth and marriage, employment letter, W-2's, medicals if the ones that you submitted have expired, you need to follow the list of documents as per the interview letter. If your spouse has been called for the interview you would need to take joint documents and photographs to show that it is a bona fide marriage.

He can have both types of permanent residence pending at the same time - marriage-based and employment-based. This is very common. The marriage-based filing will probably be approved sooner than the other, because priority dates are so backlogged now.

Just to be contrarian, I think the recent H1-B and L-1 fee increase is an opportunity. Instead of playing a victim of legislative abuse, we should come out batting with an offense. We should get businesses to lobby for us. We should get congress people educated about the unfairness. We should not say the fee is wrong, because these are after all elected officials and they will not jeopardize their election prospects by going against this measure. So we should say ok take this fee but then provide us with administrative fixes that we want.

Since there is a mad rush of i485 applications , USCIS is going to do lottery to select applications for approval.Rest of them will be rejected.
