On May 18, 2009, the Texas Senate passed a bill requiring Sheriffs or any other officers in charge of a correctional facility, to determine the “citizenship status” of all convicted felons. The bill, S.B 2584, amends Chapter 2, Code of Criminal Procedure, by adding Article 2.245. If a defendant has been convicted of a felony under Title 5 (Offenses Against the Person), Penal Code, Title 6 (Offenses Against the Family), Penal Code, Title 7 (Offenses Against Property), Penal Code, Chapter 43 (Public Indecency), Title 9 (Offenses Against Public Order and Decency), Penal Code, Chapter 45 (Weapons), Title 10 (Offenses Against Public Health, Safety, and Morals), Penal Code, and Chapter 481 (Texas Controlled Substances Act), Health and Safety Code, the sheriff or officer will make a reasonable effort to determine the defendant’s “citizenship status”. If the sheriff has reason to believe the defendant is a foreign national, within 48 hours after the defendant is received at the correctional facility, the sheriff or officer will contact the Department of Homeland Security (DHS) to verify the defendant’s immigration status. The bill becomes effective September 1, 2009.

I am on l2 since my husband is on L1. I work full time for a US employer with an EAD. Now, what would happen to my status if my husband quits his job?

Hi Guys
I went to local USCIS office today and asked about my case status. My I-485 was filled on 08Feb07 in EB2 category. A lot of people who have fillled I-485 after me, have already received green cards.
The Immigration lady was very nice and she told me that my case can not be approved as my name check is still pending with FBI. The name check was initiated on 24Feb07. She created a service ticket for me providing a target date of middle of next month. The ticket said that "Please approve asap after getting clearance from FBI". I do not know what does that mean? Still trying to figure out???
Then I asked about name check status of my dependants. She mentioned that their name check has been resolved which is different from cleared. She created a different SR for my dependants requesting Approval of Green cards as name check has been resolved again giving me mid of next month as target date. Does it mean that my depandants can get approval before my approval?
Gurus Any idea what should I expect. Do I need to continue to follow up with FBI and senators regarding my name check and collecting information for case file?

Gurus,
I am in a process of getting name change for my wife on pending I485. This is because her first name is given as 'FNU' by USCIS on the I485 file, EAD and A.P. As she did not have first name in passport.
We recently got her name change on passport by adding my(husbands name) as SURNAME. Now we want to refelect this change on EAD and 485.
For this amendment my lawyer is charging $400.
I want to know, if we can do this amendment on our own and avoid lawyer. Do any one on this forum know how to deal with this situation. Please let me know.

The G325A form contain the below text.
Applicant: Be sure to put your name and Alien Registration Number in the box outlined by heavy border below.
My lawyer mentioned that it is A# number. At present we dont need to fill anything.
Is it true?
If you have an A # you can enter it, if not then this should be self explanatory.

Do any of you received finger prints notice who has E-Filed EAD renewal between June 25th - June 30th.
We filed on June 29th with Texas Service Center and it's been a month we are waiting for FP notice.

I only know information about I-485 filing but do not know what to expect after it is filed?
Can someone tell me what to expect after things are in place? Like expecting Receipt date, fingerprinting - how many of them, what to look for and what to watch out for etc. A consolidated discussion may help many who are unaware of the system.
Who will get such information, lawyer or the applicant?
In normal circumstances (without the floodgates open) you would get a receipt within 2-3 weeks after the application is submitted. Fingerprinting happens soon after (still within a month). Then you get an EAD first, then the AP. In all this your lawyer will be informed as well as you. Sometimes your lawyer gets to hear first b4 you.
...Wait for approval of i-140 depending on date they are processing at NSC. Hope this helps. this is my 2 cents

Before i begin let me say its my mistake :(
My EAD expires Oct 08 and my lawyer sent me the forms to file in and send it back to him to be filed in Aug 08. But it was delayed by me till last week and was filed yesterday. what are my chances of getting EAD and continue working. In June 08 i went to India and came back using AP so i am not in H1 (i assume).
what should i do if i dont get EAD approved before oct 08?

Premium processing (i.e. PERM) helps labor applicants more because of the difference in processing times between regular and PERM processing.
For I-140 the average processing time is about 3 months only (source: http://www..com/usa-immigration-trackers/i140-graph/), so what's the big advantage of premium processing for I-140? Are they going to approve I-140 in one day with premium processing?

USCIS website does not shows that my I-485 has been denied but instead it says that it has been sent to AAO office(appeal processing office).
No I have not yet called attorney on extending EAD based on I-140 denial.

Is your 485 also denied? Most of the times when ever 140 is denied then the underlying 485 also gets denied and if that is the case then you cannot apply or extend for EAD or AP until your appeal is pending with AAO. I may be wrong so consult an attorney.

also try taking appointment by sending someone to the mumbai office. only a portion of the appointments are available on the internet. you can get a better date by taking a local appointment. it can be taken anywhere where there is VFS office (pune etc) if mumbai is not a convenient place for you. this was the case around 3 years ago, i dont know if it has changed now, but worth exploring the option.

My wife got a job offer on contract basis for 3 months. I am on h1 and she is on h4 so far. I am planning to stay on h1 itself. If my wife accepts this job using EAD, Does my status also changes? Is it okay if she dont find a job after this contract expires, what status she will be in during that time, h4 or EAD?
Please advice, Thanks a lot ....
No..your status will not change. You can still maintain your H1. She can go on EAD and work for 3 months and she will be in AOS status if she does not find any job. She will not go out of status. She can work 40hrs, 20hrs or 0hrs..it will not affect her status.
