Hello,
I am one of those cases where no one can get my name right. This time my visa stamp has an FNU against my first name.
I have a valid SSN, valid California DL and a valid California marriage certificate. The I-797 is not a blanket petition. It has my name as I wish it to be. I used my I-797 to get my DL couple of years back.
The question is, will the FNU create any problems at the port of entry? Will it create problems when I renew my H1-B later this year?
How would I enter my name on the I-94? As on the petition or as on the visa?

I have a green card and I'm thinking about living 50/50 in US and my home country Slovakia.
I've had GC for about 6 years and been living quite a travelling life spending more time outside US then in. Its also about 50/50 with trips always around 10mo in or out.My continuous residency is broken.
Do you think that if i live 50/50 in and out for five years they will give me citizenship with such history?
Got GC after Mom.

What is the reason behind you saying 'case may be audited' for the OP. Just curious to check your side of thoughts.
If your title falls under Job Zone 4, you can still apply for EB2. However, there is a possibility that your case will be audited.

I have 2 H1B Transfer questions for clarification.
1. Can H1B Transfer be filed when H1B Extension is pending with the current employer?
2. Do i need to have copy of I-140 approval notice for H1B Tranfer? The current employer does not share this document.

My company filed for PERM in September4,2007.Audited in October.reply was filed first week of November.Still no word on the PERM processing.My H1B visa expires June 30,2008.I have spent app. 7 weeks out of USA in the last six years.if I take a 3 week vacation out of the country can I extend my h1b visa to say September 15,2008(it will be 10 weeks total).And then be eligible for the 365 day rule for H1b extension.please reply.don't see too many options right now.

My wife and I also had our EADs renewed last month. We received our new EADs sometime in the last week of July and neither of us had any Finger Print notices.

If going out of the country for a long time as a GC holder, you may need to apply for travel document (returning resident ????) with USCIS.

I believe job description is important, not title. As discussed earlier threads, in most Financial companies software programmers have AVP or VP title. That should not matter as long as job responsibilities are same.

Guys,
After a long time I am logging into IV board. It was difficult period. Moved from TX to VA During January start. It took long to get me a good "matching" job and had to move on EAD. Sent the "proof of employment letter" to lawyer for AC21 notification.

Unfortunately, we cannot search by name. You may want to provide keywords used in your question so members can find your question. I have searched for all questions related to legal immigration in all categories and weighed my opinion one way or another.
Let's hope the IV core takes up this issue and writes up a carefully crafted question so we can all benefit from the resulting voting.

A federal judge in Phoenix on Wednesday blocked key provisions of Arizona's controversial immigration law from taking effect as scheduled Thursday, granting in part an injunction requested by the Obama administration.
U.S. District Judge Susan Bolton ruled that the injunction would apply to the portion of the state law that requires police to try to determine the immigration status of a person they arrest, stop or detain while enforcing other laws if they reasonably suspect the person is in the United States illegally.
In a lawsuit filed against Arizona, the Obama administration said the law was unconstitutional and warned that the provision would result in racial profiling and harassment of U.S. citizens, legal immigrants and foreign visitors.
Bolton said in her ruling that it was "not in the public interest" for Arizona to enforce a provision that preempts federal enforcement of immigration law.

Hi Everyone
Just wondering if anyone in the forum can help me with this question.
My original EAD applied for in June 12, 2010 was approved on Sep 2, 2010. But, the document was lost in mail and after 90 days I was instructed by USCIS to reapply.
And, I did reapply on Oct 12, 2010 and the case is pending on initial review although I received the I-797 Notice of Action 'Replacement Receipt' on Oct 15, 2010.
According to the I-9 Receipt rule, I can start work for a period of 90 days using the 'replacement receipt' which is just a similar receipt for an I-765 application but for a replacement EAD (lost in mail). This is in the I-9 handbook in the uscis.gov site.
My question is:
According to the 90 day unemployment rule starting April 8, 2008, if we start employment using the I-9 receipt rule, do the days of unemployment still count against the aggregate of 90 days allowed after the OPT start date ?( which in my case is Sep 20, 2010.. I presume because this is the date I had provided on the approved original EAD application which was approved on Sep, 2nd, 2010 and I had lost in the mail).
So, basically in this special case where both the I-9 receipt rule & 90 day unemployment rule apply, what happens with the umemployed days accrued even if i accept employment?
