My wife's and mine EAD renewal was applied on the 23rd of July (company lawyer delayed filing). I received mine in 30 days but my wife's case is still pending, though I am working on my H1 and don't need it. My wife's current EAD expires today, is there anything we can do to get the process to move faster or get her case expediated other than just wait till 90 days. There are lots of people I know who received their EADs even though their applications were sent much later. If the discontinuity is long, my wife may loose her job.

When the new company (for profit) applies for your wife's H1-B, it will be counted against the cap.

You can change the job peacefully using AC21 since your 485 is pending for more than 6months. Your labor position/location etc doesnt mater. Your current employer cannot do anything but you need to get a copy of labor and I140 from him to use AC21. Also your next job should be same or similar to the one in the labor certification. Hope this helps.

So basically while I'm waiting for the priority date to become current, I can legally work aborad for several years without any harm to my GC application at all. When the priority date becomes current, I'll just need to come back to the U.S. to file I-485.
Is that correct? Sorry for keeping asking. Just want to make sure before I make this major decision.

i hv an approved PERM & I-140. my company lawyer is not sharing the approvals with me. all i hv is a copy of the I-140 approval with the rcpt no. blanked out (however it shows the A-number). i do not hv a copy of the PERM approval or details of the job description used to file PERM.
i am planning to request USCIS for these documents by filing FOIA request. for this, i hv filled up form G-639 from the USCIS website.
my questions:
(1) are these 2 documents (approval for PERM & I-140) sufficient for me to retain my pd and/or use AC-21 in future? if not, then what r the other documents that i would need?
(2) does the PERM approval hv the job description reqd for AC-21?
(3) would i need copies of the petitions / forms filed or only the approvals would suffice?
(4) what is the approx time frame & cost in getting these documents using the FOIA process?

I am currently on H4 and it expires in a couple of months. I have my H1 approved for 2008 quota. My husband's H1 expires on sept 2007. we are applying for I-485 next month. Do i need to apply I-765 and I-131 because as per the instructions from my attorney it says the following:
-I-765 or EAD card. If you have valid H-1B valid more than one year and will not change job, you do not need EAD.
-i-131 or Advance Parole. If you have valid H-1 or H-4 visa stamping valid more than one year of if you are Canadian citizen, you do not need AP
Please clarify me whether I-765 and I-131 is required for our case.

I believe that you can travel to India - no need to worry. You can use your AP while returning - and it will work even if your GC has been approved. I personally saw this working for my friend couple of years back. He and his wife travelled to India - I was checking their mails for them. I received their GC while they were in India. They didn't have any problems in returning using AP.
I would also ask an immigration lawyer to double-check. All the best.

You are absolutely correct. The original poster's information indicates that no I-485 is pending, so I wasn't thinking about the AP alternative.

I've not get EAD and AP and been waiting for last few months. My wife got both EAD and AP. Is it good idea to call USCIS I/O about my status of EAD and AP? I applied for all 485/EAD/AP in june last week and got the notice on Aug 15th. Please check my signature for more information.

also try taking appointment by sending someone to the mumbai office. only a portion of the appointments are available on the internet. you can get a better date by taking a local appointment. it can be taken anywhere where there is VFS office (pune etc) if mumbai is not a convenient place for you. this was the case around 3 years ago, i dont know if it has changed now, but worth exploring the option.

Can anyone share the experience of H1 Visa stamping in Hyderabad. As per their web site they need quite a lot of documentation. Not sure if such doecumentation is required for visa revalidation (same category - H1) as well.

Documents asked were recent paystubs and last year's W2.

If you don't get your Cards in a reasonable timeframe, I suggest you take an appointment with your local USCIS office using infopass, and take a copy of this ruling to show them. I expect them to act promptly after seeing that you are considering suing them for the delay.
